Who can buy a freehold house in Sri Lanka?
Everything turns on one piece of legislation: the Land (Restrictions on Alienation) Act No. 38 of 2014, as amended by Act No. 21 of 2018. Your rights depend entirely on your citizenship status.
Dual citizens (Sri Lankan + Australian). You are treated as a Sri Lankan citizen under land law. You can buy, inherit, lease and sell freehold houses and land without restriction. This is the cleanest route for most of our clients.
Sri Lankan citizens living in Australia (Non-Resident Sri Lankans who still hold citizenship). Same position full freehold rights, exactly as a resident citizen.
Foreign nationals (Australians without Sri Lankan citizenship). You cannot take freehold title to land or a landed house. Your options are a freehold condominium apartment (permitted on any floor since the 2018 amendment), a lease of up to 99 years, or a Sri Lankan company with majority local ownership.

The “100% tax” you may have read about is gone
A lot of older guides still warn about a 100% tax on foreigners buying land. That was removed in 2018. The position today is not a tax at all it’s a restriction on freehold title for foreign nationals. A separate 15% land-lease tax was also abolished back in 2016. So the real question isn’t “how much extra tax will I pay” it’s “am I eligible to hold freehold,” which comes back to your citizenship status above.

Buying a house from Australia step by step
- Shortlist and virtual tour. Tell us your budget in AUD, location and bedroom count; we send 3–5 matching homes with prices confirmed and arrange a virtual walkthrough.
- Confirm your eligibility. We check your citizenship or dual-citizenship status and connect you with an independent Sri Lankan lawyer.
- Reserve and sign the SPA. A deposit reserves the home; your lawyer reviews the sale & purchase agreement before you sign.
- Remit funds from Australia. Funds are transferred from your Australian account through the appropriate banking channel. (Confirm the exact account with your bank and lawyer — see note below.)
- Settle taxes and execute the deed. Stamp duty, notary and registration fees are settled and the deed is executed, remotely or in person.

A note on moving money. For foreign buyers of apartments, funds are routed through an Inward Investment Account (IIA), which also protects the right to send sale proceeds back out later. Dual citizens and citizens are in a different position, and the account treatment can differ — always confirm the correct channel with your Sri Lankan bank and lawyer before you transfer, especially if you want to preserve the ability to repatriate proceeds when you sell.
